1. Purpose
These terms govern access to and use of the TuCM service (the "Service"), a SaaS platform for AI-driven Instagram automation, provided by Cox Security SL, Spanish Tax ID B06790224, registered office at Paseo de la Castellana, 194 — BJ, 28046 Madrid ("TuCM").
2. Acceptance
Use of the Service implies full acceptance of these terms, the Privacy Policy and the Cookie Policy. If you do not agree, do not use the Service.
3. Service description
TuCM provides, among others, the following features:
- Brand, audience and competitor analysis.
- Monthly editorial planning.
- Automatic content generation (posts, carousels, reels, stories).
- Scheduled publishing on Instagram.
- Automatic and semi-automatic comment replies.
- Metrics, auto-replan and Telegram approvals.
The Service is provided "as is" and continuously improved. TuCM may add, modify or remove features as the product evolves.
4. User account
To use the Service you must create an account with accurate, up-to-date data. You are responsible for keeping your password confidential and for any activity carried out with your account. Notify us immediately if you detect unauthorised use.
The Service is intended for users aged 18+ or with legal capacity to contract.
5. Meta connection
To operate your Instagram account you must authorise TuCM via "Login with Facebook". By doing so you:
- Agree to comply with Meta Terms and Instagram Terms.
- Confirm you are the owner or authorised admin of the account and the linked Facebook Page.
- Authorise TuCM to publish, read and reply on your behalf within the granted permissions.
- May revoke access at any time from Meta settings or your TuCM panel.
6. Acceptable use
You agree not to use the Service to:
- Publish illegal, defamatory, violent, discriminatory, sexually explicit, third-party-rights-infringing content or content that violates Instagram community standards.
- Engage in spam, deception, impersonation or metric manipulation.
- Promote illegal activities, prohibited products or fraudulent services.
- Bypass platform security or attempt to access other clients' data.
- Reverse engineer, decompile or commercially exploit the Service without authorisation.
- Overload infrastructure with massive automated requests outside normal Service usage.
Breach may lead to immediate Service suspension, without prejudice to legal action.
7. Customer content
You retain ownership of all content you upload to TuCM. You grant us a non-exclusive, worldwide, limited licence to store, process and use it solely to deliver the Service (including derivative content generation and publishing on your social networks).
You warrant that you hold all necessary rights over the content uploaded, including image rights and third-party IP.
8. Use of artificial intelligence
The Service uses third-party AI models (Anthropic, OpenAI, Black Forest Labs / fal.ai, Runway). You accept the following conditions:
- AI-generated content may contain errors, inaccuracies or unexpected results.
- TuCM applies automated quality control, but final responsibility for what is published rests with you.
- We recommend enabling Telegram pre-approval to review content before publishing.
- TuCM is not liable for damages arising from AI-generated content you have approved or authorised for automatic publishing.
9. Intellectual property
The Service software, trademarks, logos and graphics are owned by Cox Security SL. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service during the contract term. Any unauthorised exploitation is prohibited.
AI-generated content based on your instructions is your property to the extent permitted by applicable law.
10. Pricing & billing
Prices and economic terms are agreed individually based on the contracted plan. You will be clearly informed before contracting.
- The Service is billed in advance monthly periods, unless otherwise agreed.
- Each account has a monthly AI budget. When the cap is reached, the system stops operating until cycle reset or budget extension.
- Invoices are issued in compliance with applicable Spanish tax regulations.
- Non-payment entitles TuCM to suspend the Service without prior notice, without prejudice to the right to claim amounts due.
11. Termination & suspension
- You may cancel at any time from your panel or by writing to info@tucm.es. Cancellation takes effect at the end of the billed period.
- TuCM may suspend or terminate the contract immediately in case of serious breach (prohibited use, non-payment, fraud, security risk).
- After cancellation, data is retained per the Privacy Policy retention periods. You may request earlier deletion at the data deletion page.
12. Limitation of liability
To the maximum extent allowed by law:
- TuCM does not warrant uninterrupted Service operation or specific results on your social networks.
- TuCM is not responsible for decisions Meta makes about your account (suspensions, reach restrictions, API changes, etc.).
- TuCM's aggregate liability to the client is capped at the amount actually paid by the client in the last 12 months prior to the event giving rise to the claim.
- Indirect damages, lost profits, lost opportunity and reputational damage are excluded.
Nothing herein limits liability for wilful misconduct, gross negligence or anything not legally excludable.
13. Force majeure
TuCM will not be liable for breach caused by events beyond reasonable control: outages of AI providers or Meta, cyberattacks, natural disasters, war or administrative decisions.
14. Changes
TuCM may amend these terms for legal, technical or commercial reasons. We will notify you by email at least 15 days in advance. If you do not accept the new terms, you may terminate the contract without penalty before they take effect.
15. Governing law
These terms are governed by Spanish law. The parties submit any dispute to the Courts of Madrid (Spain), unless the law imposes a different forum for the consumer.
